The justice system of the US is based on the assumption that people are guilty until they
are proven guilty. Therefore, unless they are a flight risk, they should be allowed to be free until
when their cases are heard, and verdicts were given. Therefore, the justice system of the country
adopted systems of allowing suspects to return to their communities and leave freely as they wait
for trial. The cash bond system that is used in the United States is a system that dates back to
colonial America and is a system that was adapted from the English system of surety for people
who were used of crimes. Even though the system had good intentions, times have changed, and
therefore the system should be abolished because it is outdated, it targets the poor, and it is also
the commercial bail system is illegal in most countries.
One of the reasons why the cash bail system should be banned is the fact that it is based
on the discretion of the judges and the crime committed and does not consider the ability of the
person to pay (Dabney, Page & Topalli, 2017). The reliance on sureties was very important at the
time when most people were laborers, and therefore, they had to go and work. The amounts and
the reason for introducing sureties were relevant at the time. However, as times have changed,
very little has changed. Judges look at factors such as the crime committed by the defendant, the
criminal record of the person, and whether or not the person has ever missed court. The ability of
the person to pay the amounts is a very important factor that should be considered, and yet it is
left out.
The system allows for the justice system to discriminate against the group that cannot
pay. The people with the means of paying can pay the bail while those who have no means
cannot pay. The bail that the judges set from the initial appearance in courts usually affects the
likelihood of detention before the trial (Dabney, Page & Topalli, 2017). When judges set high

bail amounts, defendants become more likely to be detained because it becomes hard for the
defendants to afford the bonds and bail amounts. Usually, bonds are set very high. In California,
for instance, the median bail set in 2015 was 50,000 dollars. Those who cannot pay have to go to
choose between being detained until their cases are resolved or go to bondsmen for assistance.
Also, the United States and the Philippines are the only countries in the world with
commercial bail systems. The two countries have bail systems that are dominated by commercial
salespeople. In the rest of the world, commercial bailsmen are not legally recognized. Therefore,
they are not allowed to operate. Therefore, it is clear that the morality and legality of the practice
are questionable, and it should, therefore, be prohibited.
Even though it is clear that the bail system is not fair, judges and lawmakers are reluctant
to abolish the surety system because they are afraid that removing cash bonds will not prevent
people from participating in crime when waiting for trials (Menefee, 2018). However, the
evidence says otherwise. According to Cooper, 90% of the individuals who are released without
bail usually return to court and remain without being arrested for any other crimes in the period
before trial. Therefore, the system works.
In conclusion, the current surety system that is applied in the United States of America is
unfair to those without the means to pay them. The system favors the rich and commercial
bondsmen. Therefore, it is important that the system is changed to become fair to everyone.

According to the feedback from the previous draft, the professor said that the work was
great for a start. The professors also said that the outlining of the main points of the essay was
good. He also observed that in the next draft, more research should be included. From the

the next draft.
I used the feedback to improve my writing for the current draft. I did further research into
the issue and therefore became able to give better support for my essay. The feedback also
allowed me to know the aspects of the paper that were good such as the main points. I, therefore,
knew that I had to use the research to strengthen the points I already had. In the future, the
feedback will be important in my writing because now I understand that it is important to do
detailed research to strengthen my writing.
