Community Hospital employs several radiology technicians in Radiology Department. Eric is considered the most technically proficient tech, while Emily is considered a leader and often comes up with new ideas to make the Department a better place to work. Emily, however, is not as technically proficient as Eric but does a good job in general. The radiology director recently announced his retirement and both Eric and Emily have submitted their names to be considered for promotion. Community Hospital decides to promote Eric despite his lack of leadership and management skills. Eric receives no training for his new position. Since Erics promotion, some techs have complained about Emilys constant complaining, which they have stated is very disruptive, and her poor attitude. They also claim that Emily is making technical mistakes, but none that would result in patient harm. 1. What legal issues does this scenario raise. 2. What should Eric do when Emily alleges that Community Hospitals failure to promote her was blatant discrimination?
