STATEMENT OF (WOl)JONSSON:

26 On 01/18/2015 at approximately 0055 hours, he was riding his bike
27 with his friend (W02)ARNDT along the path that runs behind the Jerry
28 House and Kappa Alpha.
They were riding westbound along the path and
29 came close to a dumpster that is between the Jerry House and Kappa
30 Alpha. (WOl)JONSSON said movement caught his eye and he looked over
1 and saw a male subject on top of a female who was lying on her back
2 on the ground near the dumpster. It looked like the male and female
3 were having sex, as (WOl)JONSSON saw the males hips thrust several
4 times on top of the female. (WOl)JONSSON and (W02)ARNDT both talked
5 about it and thought it was a mutual interaction at first and
6 continued riding. However, (WOl)JONSSON said as he kept riding by, he
7 noticed that the female laying on the ground was not moving and
8 something seemed weird about the situation. When asked to
elaborate
9 about what seemed weird, he just said that he got a weird feeling
10 about it because it looked like the female was asleep or
11 unconscious.
12 He started riding slower and began looking intently at the male and
13 female. He could tell that the female appeared to not be moving at
14 all and he was sure something was wrong. (WOl)JONSSON told (W02)ARNDT
15 they needed to check and make sure everything was

17 (WOl)JONSSON and (W02)ARNDT got off their bikes approximately 10 yards
18 away from (S01)TURNER and (VOl} . As (WOl)JONSSON got closer he said
19 hey to (SOl)TURNER, in an effort to get his attention. He said
that
20 (SOl)TURNER looked up, saw him, slowly got up off the female and
21 began running lpretty fastl away from the area. (S01)TURNER was
22 running north easterly across
a basketball court and along the path
23 to the rear of the Jerry
House. 24
25 (WOl)JONSSON and (W02)ARNDT briefly checked on the girl and noticed
26 that she appeared to be unconscious and did not respond to them
27 asking if she was ok. (WOl)JONSSON never lost sight of (S0l)TURNER
28 and started chasing after him. He caught up to him about 35 yards
29 down the path and told (SOl)TURNER to stop several times. He said
30 that (S01)TURNER kept running and didnlt look like he was going to
2 and tripped (S01)TURNER. (SOl)TURNER fell to the ground and

said it looked like he was trying to get
4 run away again, so he tackled him to
the ground.

is not sure how long he held
(SOl)TURNER down, but
9 estimates it a few minutes. He told (SOl)TURNER he was not letting
10 him up until he figured out what was going on and he wanted to make
11 sure that (VOl) was ok. That is when the police arrived and detained
12 (SOl)TURNER.

did not see if (SOl)TURNER had his pants undone or his
15 penis out, but stated it definitely looked like (SOl)TURNER was
16 having sex with (VOl) due to the thrusting and him being on top of
17 her with her dress pulled up.

said he would absolutely be able to identify
20 (SOl)TURNER if he saw him again. (WOl)JONSSON
had never seen either
21 (SOl)TURNER or (VOl) before this incident. (WOl)JONSSON was unsure of
22 what exactly had taken place or if (VOl) was ok, so he felt it was
23 necessary to hold (S01}TURNER until someone figured this
out.

27 most likely be in contact with him and ask further questions
28 regarding this case.
