Negligence in nursing, also called malpractice is common in litigation cases. Malpractice can be defined as a violation of the way one undertake a professional duty. Malpractice can further be defined as an improper conduct and taking an unethical actions or lacking the reasonable skill to carry out a role of that office. It usually involves negligence and unskillful performance of the duties of which require professional skills. In nursing and other medical care professions, it involves the failure to meet the set standard of care and can be characterized as not using the skills or knowledge that other professionals in the same field are using. Nursing elements is further described as the action done or failure to take an action that finally leads to a breach of the expected standard care. The effects of such actions or non actions are damages such as injury or death of a patient and ensuing malpractice actions. For any legal action to be taken, it is imperative to establish the negligence needs. Negligence can be defined as the failure of the nurses to act reasonably and professionally in a situation that will cause harm to a patient (Mayberry & Croke 2006).
