Legal aspect of nursing
In legal terms, the term liability refers to a fault. The person who is at fault is liable to another due to their actions or failure to act. There are two parties to a suit in this case. There is the plaintiff, who is the patient, and the defendant, who is the health care provider. Joses parents may prove negligence of the hospital where they failed to act fast in time to save Jose from paralysis. The plaintiff can also claim delayed diagnosis on the part of the physician where he delayed Joses x-ray and then sedated him for an entire night while he could see that Jose was clearly in pain. The hospital then lacked an available anesthetist on call despite having more than one anesthetist working in the hospital. The importance of the anesthetist is explained below.
